Secretary of the Judicial Commission of Inquiry into Allegations of State Capture, Corruption and Fraud in the Public Sector including Organs of State v Zuma

On 28 January 2021 the Constitutional Court of South Africa handed down an unprecedented judgment compelling the Former President, Mr Jacob Gedleyihlekisa Zuma to obey all summonses and directives lawfully issued by the Judicial Commission of Inquiry into Allegations of State Capture, Corruption and Fraud in the Public Sector including Organs of State (Commission). This included that Mr Zuma appear and give evidence before the Commission on dates determined by it; that he does not have a right to remain silent in proceedings before the Commission; and that he is entitled to all privileges under section 3(4) of the Commissions Act, including the privilege against self-incrimination.
